Terms and Conditions of Sale

These Terms and Conditions govern the purchase of travel services provided by Sunrise Travel Company. By making a booking or payment, you (the “Client”) agree to be legally bound by these terms.

1. Agency Role and Third-Party Providers:

Sunrise Travel Company acts as an intermediary (agent) between the Client and third-party service providers (Airlines, Hotels, Tour Operators, etc.). We are not responsible for the acts, errors, or negligence of these independent providers. The Client agrees to abide by the specific terms and conditions of each individual provider.

. Nature of Services:

Sunrise Travel Company 
provides two types of travel services: those operated directly by our staff and equipment, and those where we act exclusively as a professional intermediary between the client and independent third-party providers (hotels, external transportation, airlines, etc.).

. Third-Party Responsibility: 

For tours and services operated by external providers, our agency is not legally liable for cancellations, delays, accidents, or service failures caused by said providers.

. Advocacy Commitment:

In the event of a third-party provider failure, Sunrise Travel Company commits to acting as your dedicated advocate to manage solutions, reschedules, or refunds according to the specific policies of that provider. You will never be left unattended.

. Intellectual Property: 

All content on our website, including text, tour descriptions, and photography, is the exclusive property of Sunrise Travel Company and may not be used by third parties for commercial purposes without written authorization.

2. Payments and Pricing:

All prices are subject to availability and may change until the full payment is received.

For international markets (USA, Canada, India, and others), the Client is responsible for any currency conversion fees or international transaction taxes imposed by their bank.

3. Cancellations and Refund Policy (Crucial Shield):

Non-Refundable Deposits:

All deposits are non-refundable unless otherwise stated in writing.

Service Fees:

Sunrise Travel Company reserves the right to charge a non-refundable administrative service fee for any booking.

Cancellations by Providers:

If a provider cancels a service (e.g., flight cancellation), Sunrise Travel Company will assist the Client in seeking a refund or credit, but we are not financially liable for the provider’s failure to perform.

. Price Fluctuations:

Prices for third-party services are subject to change due to government taxes or provider surcharges until the booking is confirmed with a full deposit.

4. Travel Documents and Insurance:

Responsibility:

The Client is solely responsible for obtaining all necessary visas, passports, and health certificates. We are not liable for any costs incurred due to the Client’s failure to provide correct documentation.

Insurance Recommendation:

Sunrise Travel Company strongly recommends the purchase of comprehensive travel insurance. By declining insurance, the Client acknowledges they assume all financial risks associated with travel disruptions.

5. Limitation of Liability and Force Majeure:

Sunrise Travel Company shall not be liable for any injury, loss, claim, or damage arising from:

Events of Force Majeure (Natural disasters, strikes, pandemics, government restrictions, or war).

The Client’s failure to follow instructions or meet check-in times.

Errors in information provided by the Client during the booking process.

. Nature and Wildlife:

Wildlife sightings are a gift from nature and cannot be guaranteed. We deeply respect the freedom of animals in their natural habitat; therefore, no refunds or discounts will be issued if specific sightings do not occur.

. Tropical Climate & Extreme Weather:

Rainfall is the essence that keeps Costa Rica lush and green. We are not responsible for weather-related cancellations. In case of extreme weather, we will strive to offer an alternative activity or reschedule based on availability, but weather conditions do not qualify

.Terrain and Natural Risks: 

The Client acknowledges that Costa Rica’s geography involves inherent risks. Sunrise Travel Company is not liable for accidents resulting from slippery trails, uneven terrain, weather-related changes in path conditions, or encounters with flora and fauna (including insects and marine life).

6. Dispute Resolution and Governing Law:

In the event of a dispute:

The Client agrees to notify Sunrise Travel Company in writing to seek an amicable solution before taking any legal action.

All legal claims must be submitted to binding individual arbitration in the jurisdiction of the company’s headquarters.

The Client expressly waives the right to initiate or participate in any Class Action lawsuits or collective legal proceedings.

Governing Law and Exclusive Jurisdiction:
 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Costa Rica. The Client expressly agrees that any legal action, suit, or proceeding arising out of or relating to these terms shall be instituted exclusively in the courts of San José, Costa Rica. The Client hereby waives any objection to the laying of venue or the jurisdiction of such courts.
 

7. Accuracy of Information:

While we strive for accuracy, Sunrise Travel Company does not guarantee that the website information is free of errors or omissions. We reserve the right to correct any pricing errors at any time.

8. Acceptance of Risk and Waiver of Liability:

The Client acknowledges that travel and participation in tours organized by Sunrise Travel Company may involve inherent risks, including but not limited to: physical exertion, forces of nature, civil unrest, or accidents during transportation.

By booking a service, the Client expressly agrees to the following:

Assumption of Risk:

The Client voluntarily assumes all risks associated with the trip, whether known or unknown.

. Third-Party Equipment (Vehicles/Motocross/ATV):

For activities involving the use of third-party motorized equipment, liability for any physical injury, accident, or material damage rests exclusively with the equipment provider and the user.

. Mechanical Failure & Collisions:

We are not responsible for mechanical issues, collisions, or injuries resulting from the use of equipment, vehicles, or tools that are not directly owned by our agency.

. Personal Belongings:

Clients are solely responsible for their belongings. We are not liable for damage caused by water, humidity, loss, or theft of electronic equipment (phones, cameras) or personal valuables.

Health and Fitness:

The Client certifies that they are in good physical and mental health to participate in the chosen activities and have consulted a physician if necessary.

Medical Warranty and Emergency Authorization:
 
 The Client warrants that they do not have any physical or mental condition that would make participation in the tour dangerous to themselves or others. In the event of a medical emergency, Sunrise Travel Company is authorized to secure medical treatment at the Client’s sole expense. The Agency is not responsible for the quality or outcome of such medical services.

. Health and Physical Condition:

Clients declare they are in optimal physical condition for the contracted activity. It is mandatory to disclose any allergies or medical limitations. We reserve the right to decline participation if the safety of the client or the group is deemed at risk.

. Travel Insurance & Medical Expenses:

We strongly require all travelers to secure international travel insurance. Sunrise Travel Company assumes no liability for medical expenses, medications, or emergency evacuation.

Release of Liability:

To the maximum extent permitted by law, the Client releases Sunrise Travel Company, its owners, and employees from any and all liability for injury, death, property damage, or loss, even if arising from the negligence of third-party providers.


Indemnification:

The Client agrees to indemnify and hold harmless Sunrise Travel Company against any legal claims or expenses arising from the Client’s own actions or health conditions during the trip.

Digital and Physical Acceptance:

 By completing a booking and checking the ‘Terms and Conditions’ box, the Client acknowledges that this constitutes a binding digital signature with the same legal force as a handwritten one. Furthermore, the Client agrees to sign a physical or digital Liability Waiver upon arrival if requested by Sunrise Travel Company or its providers. Refusal to sign physical safety waivers at the destination may result in service cancellation without a refund.

09. Environmental Conduct Code:

Feeding or disturbing wildlife and the removal of flora are strictly prohibited. Failure to comply with these environmental regulations will result in immediate tour termination without a refund.

10. AI Transparency and Data Privacy (EU/US Compliance)

Interactions through Artificial Intelligence assistants are used to enhance our service quality. All data is processed in accordance with GDPR (Europe) and CCPA (California) regulations. The Client reserves the right to request human intervention at any time during their interaction with our automated systems.

11. Conduct and Safety:
 
 Sunrise Travel Company reserves the right to terminate the participation of any Client whose conduct is deemed incompatible with the safety, harmony, or well-being of the group. This includes, but is not limited to, being under the influence of drugs or alcohol, harassment of staff or other travelers, or illegal acts. In such cases, no refunds will be issued.
 
12. Media Release:
 
 The Client grants Sunrise Travel Company permission to use any photographs or videos taken during the tour for promotional and marketing purposes. If the Client wishes to opt-out, they must notify the Agency in writing prior to the commencement of the tour.
